Public Notice: Monthly Sales Report Requirement

PUBLIC NOTICE

 

Governor Ralph DLG. Torres and LT. Governor Victor B. Hocog through the Office of the Secretary of Commerce hereby provide Notice to the Public and Licensed Retail Establishments that the Department of Commerce, Alcohol Beverage and Tobacco Control Division is fully implementing the Monthly Sales Report requirement for all Class-2 Retail General Licensees (for tobacco products), and Class-3 On-Sale and Class-4 Off-Sale licensees, including Class-7 Special Liquor licensees (for alcoholic beverage products), in accordance with Section 9(h) of the ABTC Rules and Regulations and § 20-10.1-140 (g) of the Northern Mariana Islands Administrative Code (NMIAC).

Therefore, Class-2 Retail General Licensees, Class-3 On-Sale and Class-4 Off-Sale licensees, including Class-7 Special Liquor licensees are required to submit monthly sales report of all alcoholic beverages and tobacco products commencing the period of January 2017.  Monthly sales report will be due for submission within 15 days of each succeeding month.

The purpose of this requirement is to collect general and accurate information on the actual number of individual sales of alcoholic beverages and tobacco products from the licensed retailers on a monthly basis.  The ABTC division does not intend to collect information with respect to the actual inventory of alcohol and tobacco products currently at hand, nor does it intend to collect information with respect to the actual dollar amount of sales generated from the licensed retailers.

Failure to provide the above report on a monthly basis may result in an automatic suspension of license, which the suspension shall not exceed 48 hours from the date and time the license is suspended in accordance with 4 CMC, § 5598 as amended by Public Law 17-83, and Section 11(b) of the ABTC Rules and Regulations, and § 20-1.10-150 (2) of the NMIAC.  By operation of law, subsequent or continuous failure to comply with this requirement may result in an automatic revocation of license upon the determination of the Director of ABTC and Secretary of Commerce in accordance with 4 CMC, § 5597(b) as amended by Public Law 17-83, and Sections 11(a)(2), (b)(3) of the ABTC Rules and Regulations, and § 20-1.10-150 (a)(2) of the NMIAC.

All Class-2 Retail General Licensees (for tobacco products), Class-3 on-Sale and Class-4 Off-Sale licensees, including Class-7 Special Liquor licensees (for alcoholic beverage products), are encouraged to submit their signed reports preferably via electronic mail (email) to reports.abtc@commerce.gov.mp.  If no email access available, please submit original signed report via hand delivery to the Department of Commerce, One Stop Regulatory Processing Center, no later than 15 days after the end of each month (submission via fax will not be accepted).

To provide a more user friendly and convenient access for submitting the monthly sales report, the ABTC Division is currently constructing a web base form for licensees to be submitting their reports online via the Department of Commerce website.  All licensees will be notified accordingly upon the completion of the web base reporting access.
